Résumé
Libya is an important African country because of its oil wealth and strategic location. Libya has experienced human rights violations beginning with Italian colonization.During the reign of King Idriss, the rights of citizens were recognized, and the first Constitution was promulgated. Al-Gaddafi overthrew the regime. During his regime, the issue of human rights has evolved, but also knew many violations.The issue of human rights aroused a keen interest from citizens before the Arab Spring, which triggered a popular uprising against the regime in 2011. This uprising led to a military intervention by the NATO under the pretext of protecting civilians. The regime has been reversed.A civil war broke out, engendering many human rights abuses that had a major impact on the areas of life, where terrorism, kidnappings and extrajudicial executions spread like never before.We have tried to apprehend the legal efforts to guarantee human rights in a situation where there is adherence to international conventions and agreements without these being respected. We also tried to understand the role of civil society institutions and Libyan political parties and tribes in social reconciliation and the formation of legal guarantees for the protection of human rights. We tried to identify and reflect on the possibilities of national reconciliation at the end of the civil war. Considering the imperative need to recreate a State and national institutions, we analyzed the role of the United Nations and regional organizations.
La Libye est un pays africain important en raison de sa richesse pétrolière et de son emplacement stratégique. La Libye a connu des violations des droits de l’Homme commençant par la colonisation italienne. Sous le règne du Roi Idriss, elle a reconnu des droits aux citoyens et a vu la promulgation de sa première constitution. Al-Kadhafi a renversé le régime. Cette période a connu une évolution sur la question des droits de l’Homme, mais aussi de nombreuses violations. La question des droits de l’Homme a suscité un vif intérêt de la part des citoyens avant le Printemps arabe, ce qui a provoqué le déclenchement d'un soulèvement populaire contre le régime en 2011. Ce soulèvement a conduit à une intervention militaire de l'OTAN sous prétexte de protéger les civils. Le régime a été renversé.Une guerre civile a éclaté engendrant de nombreuses violations des droits de l’Homme qui ont eu un impact majeur sur les domaines de la vie, où le terrorisme, les enlèvements et les exécutions extrajudiciaires se sont étendus comme jamais auparavant.Nous avons essayé d’appréhender les efforts juridiques pour garantir des droits de l’Homme dans une situation où il y a une adhésion aux conventions et accords internationaux sans que ceux-ci soient respectés.Nous avons également tenté d’appréhender le rôle des institutions de la société civile et des partis politiques et des tribus libyens dans la réconciliation sociale et la formation de garanties juridiques pour la protection des droits de l'Homme. Nous avons essayé d'identifier et de réfléchir aux possibilités de réconciliation nationale à la fin de la guerre civile. Considérant la nécessité impérieuse de recréer un État et des institutions nationales unies, nous avons analysé le rôle des Nations Unies et des organisations régionales.
